Driver Independent Contractor Agreement

This Driver Independent Contractor Agreement ("Agreement") is entered into between Peyelis Logistics and Delivery ("Company," "we," "our," or "us") and the individual or entity accepting delivery assignments ("Driver," "Contractor," or "you").

By accepting delivery assignments, accessing the driver portal, or performing deliveries on behalf of the Company, you agree to the terms of this Agreement.

1.Independent Contractor Relationship

Drivers operate as independent contractors and not employees, partners, or agents of Peyelis Logistics and Delivery.

Drivers acknowledge that:

  • They control how they perform deliveries
  • They are responsible for their own taxes
  • They are not entitled to employee benefits
  • The Company does not guarantee minimum work hours or earnings

2.Driver Requirements

To qualify as a driver, you must:

  • Be at least 18 years old
  • Possess a valid driver's license
  • Maintain valid vehicle insurance
  • Have a reliable, roadworthy vehicle
  • Pass any required background checks (if applicable)
  • Maintain a working smartphone for app access and communication

3.Vehicle Requirements

Drivers are responsible for maintaining their vehicles in safe operating condition, including:

  • Brakes
  • Tires
  • Lights
  • Registration
  • Insurance coverage

The Company is not responsible for vehicle maintenance or repairs.

4.Delivery Responsibilities

Drivers agree to:

  • Complete deliveries in a timely and professional manner
  • Follow all traffic laws and safety regulations
  • Maintain accurate status updates in the driver portal
  • Provide proof of delivery when required
  • Handle all packages with care
  • Communicate delays or issues promptly

5.Prohibited Conduct

Drivers may NOT:

  • Open, tamper with, or inspect packages
  • Deliver illegal or prohibited items knowingly
  • Transport unauthorized passengers during deliveries
  • Misrepresent delivery status
  • Harass customers or engage in unprofessional behavior
  • Use drugs or alcohol while on active delivery status
  • Subcontract deliveries without permission

Violation of these rules may result in immediate deactivation.

6.Payment Terms

Drivers are compensated based on completed deliveries as defined by the Company.

Payments are:

  • Issued according to the Company's payout schedule
  • Based on completed and verified deliveries
  • Subject to adjustment for cancellations, errors, or failed deliveries

The Company reserves the right to withhold payment for fraudulent, incomplete, or disputed deliveries.

7.Wait Time and Delays

Drivers may receive additional compensation for wait time only when authorized by the system.

Drivers must notify the Company immediately of:

  • Customer unavailability
  • Pickup delays
  • Delivery complications

8.Cancellations

The Company reserves the right to cancel or reassign deliveries at any time.

Drivers will only be compensated for completed or eligible canceled deliveries as determined by Company policy.

9.Safety Policy

Drivers have the right to refuse delivery if:

  • The location is unsafe
  • They feel threatened or harassed
  • Weather or road conditions are dangerous
  • The package appears illegal or unsafe

Drivers must report all safety concerns immediately.

10.Insurance Responsibility

Drivers are solely responsible for maintaining:

  • Auto insurance coverage
  • Any required business insurance (if applicable)

The Company does not provide vehicle insurance coverage.

11.Liability

Drivers are responsible for their actions during delivery operations.

The Company is not liable for:

  • Vehicle accidents
  • Personal injury
  • Traffic violations
  • Damage caused by the driver's negligence
  • Loss or damage caused by improper handling

12.Confidentiality

Drivers agree not to disclose:

  • Customer information
  • Delivery locations
  • Business operations
  • Internal pricing systems
  • Company technology or processes

13.Performance Standards

Drivers are expected to maintain:

  • Professional behavior
  • Timely communication
  • Accurate delivery updates
  • Respectful customer interaction

Failure to meet performance standards may result in reduced access to delivery opportunities or deactivation.

14.Deactivation

The Company may deactivate a driver account at any time for:

  • Policy violations
  • Fraud or misconduct
  • Safety concerns
  • Repeated delivery issues
  • Customer complaints
  • Legal or regulatory issues

15.Relationship to Customers

Drivers acknowledge they are acting solely as independent contractors fulfilling delivery assignments and do not represent themselves as employees of the Company to customers.

16.Termination

Either party may terminate this Agreement at any time.

Termination does not affect obligations related to:

  • Completed deliveries
  • Confidentiality
  • Outstanding payments or disputes

17.Governing Law

This Agreement shall be governed by the laws of the State of South Carolina.

18.Acceptance of Agreement

By accepting delivery assignments, logging into the driver platform, or completing deliveries for Peyelis Logistics and Delivery, you acknowledge that you have read, understood, and agree to be bound by this Agreement.
